& strong>Rules for the import of quarantined products into the Russian Federation/strong>
The import into the Russian Federation of quarantined products of high phytosanitary risk and low phytosanitary risk is carried out at checkpoints across the State Border of the Russian Federation, which have phytosanitary control posts./li>
The import into the Russian Federation of quarantined products of high phytosanitary risk is carried out at checkpoints across the State Border of the Russian Federation, which are defined in accordance with the legislation of the Russian Federation, are specially equipped, designed for the import into the Russian Federation of such quarantined products and have phytosanitary control posts (hereinafter referred to as specialized checkpoints)./li>
Quarantined products that meet quarantine phytosanitary requirements are allowed to be imported into the Russian Federation./li>
Quarantine phytosanitary requirements for the import into the Russian Federation of quarantined products of high phytosanitary risk, established by the federal executive authority responsible for control and supervision in the field of plant quarantine, may include:ul style="list-style-type: disc;">
11) quarantine phytosanitary disinfection of such quarantined products;/li>
22) special conditions of transportation of such quarantined products or equipment of vehicles;/li>
33) import of such quarantined products into the Russian Federation through specialized checkpoints./li>
55. In respect of quarantined products of high phytosanitary risk imported into the Russian Federation, requirements are established in accordance with Article 15 of this Federal Law./li>
66. Importation into the Russian Federation of quarantined products of high phytosanitary risk can be carried out only if there is a phytosanitary certificate issued by the national organization for quarantine and plant protection of the exporting country, on the territory of which a batch of such quarantined products has been formed./li>
77. The provisions of Part 6 of this Article do not apply to the import of quarantined products into the Russian Federation:ul style="list-style-type: disc;">
11) transported in mail, in hand luggage and luggage of passengers, crew members of ships, river vessels, aircraft, vehicles, train crews, provided that the amount of such quarantined products does not exceed five kilograms and it is not seeds (seed material), planting material or potatoes;/li>
22) transported in the form of wood packaging or fastening materials, provided that such quarantined products are used when they are imported into the Russian Federation as packaging or fastening of other goods imported into the Russian Federation. An official of the federal executive authority exercising the functions of control and supervision in the field of plant quarantine, when carrying out an inspection or inspection of such quarantined products, checks the presence and correctness of its labeling with a special international standard sign indicating its compliance with the quarantine phytosanitary requirements of the importing country;/li>
33) high phytosanitary risk, transported by vehicles and intended for feeding crew members of these vehicles without granting them the right to remove it from vehicles. Food stocks infected and (or) clogged with quarantine facilities and transported by these vehicles, according to the order of an official of the federal executive authority exercising functions of control and supervision in the field of plant quarantine, must be disinfected or sealed in special warehouses for the period of the vehicle's stay on the territory of the Russian Federation or destroyed./li>
88. It is prohibited to import quarantined products into the Russian Federation for the purpose of using them for crops and plantings from foreign states or groups of foreign states where the spread of quarantine facilities characteristic of such quarantined products has been detected, without control by the federal executive authority exercising functions of control and supervision in the field of plant quarantine, in places of cultivation, shipments of such quarantined products./span>
99. Sowing and planting of quarantined products specified in part 8 of this Article on the territory of the Russian Federation shall be carried out under the control of the federal executive authority exercising the functions of control and supervision in the field of plant quarantine, in accordance with the procedure established by the federal executive authority exercising the functions of developing state policy and regulatory regulation in the field of quarantine of plants./li>
110. The import of soil into the Russian Federation is allowed only for scientific purposes in accordance with the procedure established by the federal executive authority responsible for the development of state policy and regulatory regulation in the field of plant quarantine./li>
& General provisions on the implementation of quarantine phytosanitary control during import/h4>
33.1. Quarantine phytosanitary control (supervision) is subject to each batch of quarantined products imported into the customs territory of the Eurasian Economic Union,a href="/en/sertifikatsiya/fitosanitarnye-trebovaniya/perechen-produktsii-podlezhashchej-fitosanitarnomu-kontrolyu">included in the List of quarantined products/a>..br />Phytosanitary certificate/a> for a consignment of quarantine products of high phytosanitary risk imported into the customs territory of the Eurasian Economic Union, it is filled out in one of the official languages of the member States and (or) English, unless otherwise established by international treaties of the member States.br />A phytosanitary certificate issued in electronic form for the purposes of quarantine phytosanitary control (supervision) is provided by the authorized body of the exporting country (re-exporter) through the use of an information system./li>
33.2. Quarantine phytosanitary control (supervision) during import is carried out at the places of completion of customs clearance, unless otherwise provided for in paragraph 3.9 of this Regulation. For quarantined products, the completion of customs clearance of which will take place at the place of delivery, quarantine phytosanitary control (supervision) at the place of arrival (primary quarantine phytosanitary control (supervision)), as well as quarantine phytosanitary control (supervision) at the places of completion of customs clearance (secondary quarantine phytosanitary control (supervision)) is carried out. Quarantine phytosanitary control (supervision) during import is carried out by officials of the authorized bodies of the Member States in whose territory the place of arrival or the place of delivery of quarantined products is located. At the place of delivery of quarantined products, the original phytosanitary certificate of the exporting country, issued on paper, is subject to seizure during quarantine phytosanitary control (supervision)./li>
33.3. Quarantine phytosanitary control (supervision) during import is carried out in order to verify compliance of imported quarantined products with the Unified Quarantine Phytosanitary Requirements for Quarantined products and quarantined facilities at the customs border and on the customs territory of the Eurasian Economic Union, approved by the Eurasian Economic Commission (hereinafter - the unified quarantine phytosanitary requirements).ul>
33.4. In order to focus on areas of increased risk and ensure more efficient use of available resources, accelerate the implementation of quarantine phytosanitary control (supervision) while maintaining the achieved level of phytosanitary safety, authorized bodies, in cases provided for by this Regulation, apply a phytosanitary management system to determine control measures carried out when importing specific batches of quarantined products. risk, if it is provided for by the legislation of the Member State, the authorized body of which carries out control (supervision). The strategy and tactics of applying the phytosanitary risk management system in the implementation of quarantine phytosanitary control (supervision) during importation are determined by the legislation of the Member States./li>
33.5. Primary quarantine phytosanitary control (supervision) during import provides for the following control measures:ul>
11) documentary verification;/li>
22) vehicle inspection;/li>
33) inspection or inspection of quarantined products - in relation to quarantined products of high phytosanitary risk, selectively, taking into account the phytosanitary risk management system;/li>
44) inspection of quarantined products - after decontamination of quarantined products, if the decision to decontaminate quarantined products was made by an official of the authorized body based on the results of its inspection or inspection./li>
33.6. In the case of referral for quarantine phytosanitary examination of samples (samples) selected during inspection within the framework of primary quarantine phytosanitary control (supervision) during import, quarantined products are not delayed until an official of the authorized body receives the conclusion of quarantine phytosanitary examination, provided that during visual inspection and (or) analysis of samples (samples) of quarantined products, organisms similar in morphological features to quarantine objects, symptoms of plant diseases, signs of damage to quarantined products by quarantine objects were not found.br />In this case, the conclusion of the quarantine phytosanitary examination is sent by the quarantine phytosanitary (testing) laboratory to the authorized body of the Member State that took samples (samples) of quarantined products. The specified authorized body shall notify the authorized body of the Member State at the place of completion of customs clearance if the expert opinion confirms contamination (clogging) of quarantined products.br />If, during visual inspection and (or) analysis of samples (samples) of quarantined products, organisms similar in morphological characteristics to quarantine objects are found, the decision on further movement of quarantined products is made by an official of the authorized body after receiving the conclusion of the quarantine phytosanitary examination, but no later than 72 hours after sampling (samples) quarantined products./li>
33.7. Quarantine phytosanitary control (supervision) upon import at the place of completion of customs clearance provides for the following control measures:ul>
11) documentary verification;/li>
22) inspection of vehicles - if the place of completion of customs clearance is the place of arrival of quarantined products;/li>
33) inspection of quarantined products - in relation to quarantined products of low phytosanitary risk;/li>
44) inspection or inspection of quarantined products - in relation to quarantined products of high phytosanitary risk, selectively, taking into account the phytosanitary risk management system;/li>
55) inspection of quarantined products - after decontamination of quarantined products, if the decision to decontaminate quarantined products was made by an official of the authorized body based on the results of its inspection or inspection;/li>
33.8. In the case of sending samples (samples) of quarantined products selected during inspection within the framework of quarantine phytosanitary control (supervision) at the place of customs clearance for quarantine phytosanitary examination, quarantined products are delayed until an official of the authorized body receives the conclusion of quarantine phytosanitary examination.br />The legislation of the Member States may provide for a deadline for which quarantined products may be delayed, as well as the consequences of the expiration of such a period until the conclusion of the quarantine phytosanitary examination is received.br />The legislation of a Member State may provide for cases when, before receiving the conclusion of a quarantine phytosanitary examination, an official of the authorized body of the Member State decides to allow the release of quarantined products subject to conditions (conditions at the place of storage, restrictions on turnover, etc.)./li>
33.9. Quarantine phytosanitary control (supervision) when importing quarantined products in transit through the customs territory of the Eurasian Economic Union to third countries, following in sealed, serviceable and sealed wagons, vans, containers, refrigerated trucks, is carried out at the place of arrival of quarantined products through documentary verification and inspection of vehicles for the presence of quarantine facilities included in the the unified list of quarantine facilities of the Eurasian Economic Union, approved by the Eurasian Economic Commission./li>
33.10. The results of quarantine phytosanitary control (supervision) at the place of arrival and at the places of delivery are formalized by:ul>
11) affixing by an official of the authorized body that carried out measures for quarantine phytosanitary control (supervision):ul>
the corresponding stamp on the phytosanitary certificate (if any) and the transport (transportation) document according to Appendix No. 1 - in case of presentation of the phytosanitary certificate (if any) and the transport (transportation) document on paper;/li>
marks through the use of an information system in accordance with Appendix No. 1.1 - in the case of submission of a phytosanitary certificate and (or) a transport (transportation) document in electronic form;/li>
22) drawing up an act of quarantine phytosanitary control (supervision) (on paper or in electronic form) in accordance with Appendix No. 2.br />The introduction of additional regulations and additional restrictions on the turnover of products into the act of quarantine phytosanitary control (supervision) is not allowed./li>
33.10.1. In case of submission of a phytosanitary certificate and (or) a transport (transportation) document in electronic form, information on the results of quarantine phytosanitary control (supervision) is sent to other regulatory authorities and the person who submitted the documents and information through an information system./li>
33.11. If the legislation of a Member State provides for the collection of fees for the implementation of certain control measures and (or) the examination of samples (samples) of quarantined products, the amount of such fees is determined by tariffs approved in accordance with the procedure established by the legislation of the Member State./li>
33.12. Officials of authorized bodies carrying out quarantine phytosanitary control (supervision) shall be provided with uniforms in accordance with the procedure established by the legislation of the Member States./li>
Measures for quarantine phytosanitary control (supervision) during import/h4>
44.1. Documentary verification/h3>
Documentary verification/h4>
44.1.1. In order to carry out a documentary check, an official of the authorized body must be presented:ul>
44.1.2. An official of the authorized body, on the basis of submitted commercial and transport (transportation) documents, establishes:ul>
11) the name of the quarantined products;/li>
22) the place of origin (production, formation) of a batch of quarantined products in order to apply prohibitions on the import of batches of quarantined products originating from a certain state, a certain area or produced (formed) at a certain enterprise, introduced in accordance with the legislation of the member State in whose territory the place of completion of customs clearance is located./li>
44.1.3. An official of the authorized body, based on an analysis of the submitted commercial and transport (transportation) documents, decides to ban the import of a batch of quarantined products or place a batch of quarantined products under the customs procedure of customs transit if:ul>
11) a phytosanitary certificate has not been submitted for a batch of quarantined products of high phytosanitary risk, except in cases of import of wood packaging and fasteners, as well as cases provided for by uniform quarantine phytosanitary requirements;/li>
22) quarantine objects are imported, and a permit for their import for research purposes has not been submitted, or the import of such objects for research purposes is not permitted in accordance with the legislation of the member State whose quarantine phytosanitary requirements the consignment must meet;/li>
33) the established place of origin (production, formation) of a batch of quarantined products corresponds to the imposed ban on the import of batches of quarantined products originating from a certain state, a certain area or produced (formed) at a certain enterprise, and the specified batch was shipped later than the moment from which such a ban was introduced./li>
44.1.4. An official of the authorized body checks the submitted phytosanitary certificate and decides to ban the import of a batch of quarantined products of high phytosanitary risk or its placement under the customs procedure of customs transit in the following cases:ul>
22) the availability of reliable information that the actual number of quarantined products in a batch of quarantined products exceeds the amount specified in the phytosanitary certificate by ten percent or more;/li>
33) the phytosanitary certificate is fake or invalid;/li>
44) the phytosanitary certificate does not confirm the compliance of the batch of quarantined products with the quarantine phytosanitary requirements./li>
44.1.5. A phytosanitary certificate is recognized as fake in the following cases:ul>
11) the phytosanitary certificate was issued by an unauthorized body;/li>
22) the phytosanitary certificate does not meet the established requirements for the form on which the phytosanitary certificate is issued./li>
44.1.6. The phytosanitary certificate is invalidated in the following cases:ul>
11) the phytosanitary certificate is not fully issued;/li>
22) a phytosanitary certificate was issued for a batch of quarantined products after its actual departure from the territory of the Member State whose authorized body issued it, with the exception of phytosanitary certificates issued for replacement, provided that the authorized body of the exporting country provides and confirms:ul>
phytosanitary safety of quarantined products;/li>
sampling, inspection and processing of quarantined products required to comply with quarantine phytosanitary requirements prior to shipment of quarantined products;/li>
the integrity of quarantined products from the moment of shipment to the moment of import of quarantined products into the customs territory of the Eurasian Economic Union;/li>
33) the validity period of the phytosanitary certificate (the period from the date of issue of the phytosanitary certificate) has expired, if such a period is provided for by the legislation of the Member State in whose territory the place of completion of customs clearance is located;/li>
44) the phytosanitary certificate indicates the number of the vehicle that does not correspond to the actual number of the vehicle, except for the case specified in paragraph 4.1.10 of this Regulation;/li>
55) a phytosanitary certificate issued on paper contains changes or additions that are not certified by the authorized body that issued it;/li>
66) a phytosanitary certificate for a batch of quarantined products that are prohibited for importation is issued after the introduction of such a ban by the Member State in whose territory the place of completion of customs clearance is located, or after the date (expiration of a certain period) provided for by the decision on the introduction of such a ban;/li>
77) the information from the phytosanitary certificate does not correspond to the information contained in commercial and transport (transportation) documents./li>
44.1.7. The phytosanitary certificate is recognized as not confirming the compliance of the imported batch of quarantined products with the quarantine phytosanitary requirements in the following cases:ul>
11) the absence in the phytosanitary certificate of information on compliance with the uniform quarantine phytosanitary requirements in force on the date of issue of the phytosanitary certificate and not expired on the date of documentary verification;/li>
22) determination based on the results of inspection or inspection of quarantined products:ul>
absence of labeling on the packaging of a batch of quarantined products (if the unified quarantine phytosanitary requirements provide for the packaging and labeling of a batch of quarantined products);/li>
inconsistencies of the information contained in the labeling of the packaging of a batch of quarantined products with the unified quarantine phytosanitary requirements and (or) information from the phytosanitary certificate for this batch of quarantined products./li>
44.1.8. An official of the authorized body checks the permit for the import of quarantine objects for scientific research purposes and decides to ban the import of a batch of quarantine objects or its placement under the customs procedure of customs transit if the specified permit is issued by an unauthorized person, or does not correspond to the batch of quarantine objects submitted for quarantine phytosanitary control (supervision)./li>
44.1.9. In cases where, based on the results of a documentary check, an official of the authorized body decides to ban the import of a batch of quarantined products, or placing a batch of quarantined products under the customs procedure of customs transit, quarantined products are subject to return or destruction at the expense of the owner of the products./li>
44.1.10. A discrepancy between the number of a tractor truck and the number indicated in the phytosanitary certificate is not a reason for invalidating the phytosanitary certificate, provided that the numbers of the semi-trailer and trailer towed by it (if any) match the numbers indicated in the phytosanitary certificate./li>
44.2. Inspection of vehicles/h3>
Vehicle inspection/h4>
44.2.1. During the inspection of vehicles by an official of the authorized body, a visual inspection of vehicles and transportation devices (including cabins, salons, luggage and cargo compartments of vehicles, containers) is carried out without opening containers and packaging and taking samples (samples) of products./li>
44.2.2. The inspection of vehicles is carried out in order to:ul>
11) establishing the conformity of vehicles with the information specified in the phytosanitary certificate;/li>
22) determination of the presence or absence of quarantine objects or signs of infection (clogging) by them on the surface of vehicles and transportation devices;/li>
33) determination of the presence or absence of spills of grain, seeds of leguminous and oilseed crops, products of their processing imported in bulk in containers, grain wagons and by road./li>
44.2.3. If, during the inspection of the vehicle, devices for transporting organisms similar in morphological features to quarantine objects are found on its surface and (or) the surface, samples (samples) of material containing these insects, weed seeds are taken for quarantine phytosanitary examination./li>
44.2.4. Based on the results of the inspection of vehicles, an official of the authorized body decides to ban the import of a batch of quarantined products or prohibit its placement under the customs procedure of customs transit in the following cases:ul>
11) information about the vehicle number does not correspond to the information specified in the phytosanitary certificate, with the exception of information about the number of the tractor unit, provided that the information about the numbers of the semi-trailer and trailer towed by it (if available) coincide with those specified in the phytosanitary certificate. In this case, the quarantined products are subject to return or destruction at the expense of the product owner;/li>
22) organisms found on the surface of the vehicle are quarantine objects. In this case, the vehicle is subject to cleaning and (or) disinfection, and if it is impossible to carry them out, or the owner of the product refuses to carry them out, it is returned together with the transported batch of quarantined products. After cleaning and (or) disinfection of the vehicle, it is subject to repeated inspection, and quarantined products to other control measures, if they must be carried out in accordance with sub-paragraphs 3.5, 3.8 and 3.10 of this Regulation;/li>
33) spills of grain, seeds of leguminous and oilseed crops, products of their processing, imported in bulk in containers, grain wagons and by road, were found. In this case, the owner of the product takes measures to eliminate spills. After the spillage is eliminated, the vehicle is subject to repeated inspection./li>
44.3. Inspection of quarantined products/h3>
Inspection of quarantined products/h4>
44.3.1. During the inspection of quarantined products by an official of the authorized body, a visual inspection of quarantined products is carried out without opening the container and packaging./li>
44.3.2. Inspection of quarantined products is carried out in order to:ul>
11) establishing the conformity of products with the information specified in the phytosanitary certificate, the permit for the import of quarantine facilities for research purposes;/li>
22) determination of the presence or absence of quarantine objects or signs of infection (clogging) on the surface of containers and packaging;/li>
33) determining the presence or absence of labeling on the packaging of a batch of quarantined products, as well as information that should be contained in the labeling (if the unified quarantine phytosanitary requirements provide for the packaging and labeling of a batch of quarantined products);/li>
44) determining the presence of markings on wood packaging and fasteners according to one of the forms provided for by the unified quarantine phytosanitary requirements, confirming the processing of these materials by heating through the entire thickness of the wood or fumigation, as well as compliance of wood packaging and fasteners with the unified quarantine phytosanitary requirements./li>
44.3.3. In case of detection during inspection of quarantined products on its surface, in containers and (or) packaging of organisms similar in morphological features to quarantine objects, symptoms of plant diseases, signs of damage to quarantined products by quarantine objects, quarantine products are inspected in accordance with paragraph 4.4 of this Regulation./li>
44.3.4. Based on the results of the inspection of quarantined products, an official of the authorized body decides to ban the import of a batch of quarantined products or prohibit its placement under the customs procedure of customs transit in cases where during the inspection it is established that:ul>
11) quarantined products are quarantined products of high phytosanitary risk, and commercial and (or) transport (transportation) documents indicate the name of products with low phytosanitary risk, and a phytosanitary certificate for this batch of quarantined products is not provided;/li>
22) information about the product name does not correspond to the information specified in the phytosanitary certificate;/li>
33) quarantine objects have been found on the surface of quarantined products and packages, with the exception of cases provided for by the unified quarantine phytosanitary requirements when the import of infected quarantined products is allowed;/li>
44.4.1. Inspection of quarantined products provides for:ul>
11) visual inspection of a batch of quarantined products completely unloaded from a vehicle or placed in a vehicle in such a way that an official of the authorized body has access to inspect any part of the batch of quarantined products and the opportunity to take samples (samples) from various parts of the batch of quarantined products;/li>
22) sampling from various parts of the batch of quarantined products;/li>
33) examination of selected samples (samples);/li>
44) verification of the presence on wood packaging and fastening materials of markings according to one of the forms provided for by the unified quarantine phytosanitary requirements, confirming the processing of these materials by heating through the entire thickness of the wood or fumigation, as well as compliance of such materials with the unified quarantine phytosanitary requirements;/li>
55) verification of the presence or absence of labeling on the packaging of quarantined products, as well as information that should be contained in the labeling (if the unified quarantine phytosanitary requirements provide for the packaging and labeling of quarantined products)./li>
44.4.2. Sampling is carried out by an official of the authorized body and (or) by decision of the authorized body by specialists of the quarantine phytosanitary (testing) laboratory after establishing compliance of the quarantined products with the information specified in commercial, transport (transportation) documents, phytosanitary certificate, permission to import quarantine objects for research purposes, as well as establishing the fact of the absence of quarantine facilities on the surface of quarantined products. The number and method of sampling (samples) are determined by the legislation of the Member State./li>
44.4.2.1. The results of the analysis of samples (samples) of quarantined products are reflected in the act of quarantine phytosanitary control (supervision)./li>
44.4.2.2. Samples (samples) of quarantined products intended for quarantine phytosanitary examination are packed, sealed, transported, stored, used and destroyed in accordance with the Procedure for Laboratory Support of Quarantine Phytosanitary Measures approved by Decision No. 41 of the Board of the Eurasian Economic Commission dated May 10, 2016. Samples (samples) of quarantined products used during quarantine phytosanitary examination (except for the case provided for in paragraph 13.1 of the specified Procedure) are not returned to the owner, their cost is not reimbursed to the owner./li>
44.4.2.3. When making a decision on the presence or absence of contamination (clogging) of quarantined products by quarantine facilities, an official of the authorized body is guided by the conclusions set out in the conclusion of the quarantine phytosanitary examination./li>
44.4.3. Based on the results of the inspection of quarantined products, an official of the authorized body decides to ban the import of a batch of quarantined products or prohibit its placement under the customs procedure of customs transit in cases where during the inspection it is established that:ul>
11) quarantined products are quarantined products of high phytosanitary risk, and commercial and (or) transport (transportation) documents indicate the name of products with low phytosanitary risk and do not provide a phytosanitary certificate for this batch of quarantined products;/li>
22) the information about the product name does not correspond to the information specified in the phytosanitary certificate;/li>
33) the fact of infection (clogging) has been established (based on the results of a study of the quarantine phytosanitary condition of samples) quarantined products by quarantine facilities, except in cases provided for by uniform quarantine phytosanitary requirements;/li>
44) there is no labeling on the packaging of a batch of quarantined products (if the unified quarantine phytosanitary requirements provide for the packaging and labeling of a batch of quarantined products);/li>
55) the information contained in the labeling of the packaging of a batch of quarantined products does not comply with the unified quarantine phytosanitary requirements and (or) information from the phytosanitary certificate for this batch of quarantined products./li>
44.4.4. Based on the results of the inspection of wood packaging and fastening materials, an official of the authorized body decides to ban their import if, during the inspection, it is established that these materials do not have markings according to one of the forms provided for by the unified quarantine phytosanitary requirements, confirming the processing of such materials by heating through the entire thickness of the wood or fumigation, or wood packaging and fastening materials do not comply with the uniform quarantine phytosanitary requirements./li>
