Regulations on the procedure for the import into the customs territory of the Customs Union of products (goods) in respect of which mandatory requirements for conformity assessment are established within the Customs Union

Decision of the Board of the Eurasian Economic Commission No. 294 of December 25, 2012

  1. This Regulation was developed in pursuance of the EAEU Agreement of 18.10.2011, the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of 18.10.2010 and the Agreement on the Circulation of Products Subject to Mandatory Conformity Assessment (Confirmation) in the Customs Territory of the Customs Union of 11.12. 2009.
  2. The products (goods) imported into the customs territory of the Customs Union, in respect of which, during its customs declaration, documents certifying the compliance of such products (goods) with mandatory requirements or information about such documents are submitted to the customs authorities simultaneously with the customs declaration, include products (goods) that:
    • a) included in the Unified List of products for which mandatory requirements are established within the Customs Union, approved by the Decision of the Customs Union Commission No. 526 dated 28.01.2011 "On the Unified List of products for which mandatory requirements are established within the Customs Union", and in respect of which the legislation of the member States of the Customs Union (hereinafter - member States) mandatory requirements are established;
    • b) included in the Unified List of products subject to mandatory Conformity Assessment (confirmation) within the Customs Union with the Issuance of Uniform Documents, approved by the Decision of the Customs Union Commission dated 7.04.2011 No. 620 "On the new edition of the Unified List of Products subject to mandatory Conformity Assessment (confirmation) within the Customs Union with the Issuance of Uniform Documents, approved by the Decision Commission of the Customs Union No. 319 dated 18.06.2010" (hereinafter referred to as the Unified List);
    • c) is included in the lists of products for which the submission of a customs declaration is accompanied by the submission of a document on the assessment (confirmation) of compliance with the requirements of the technical regulations of the Customs Union.
  3. The documents certifying the conformity of products (goods) with mandatory requirements include:
    • a) a document on conformity assessment (confirmation) provided for by the technical regulations of the Customs Union;
    • b)certificate of conformityordeclaration of conformityCustoms Union, issued in a single form, for products (goods) included in a Single list;
    • c) certificate of conformity, declaration of conformity provided for by the legislation of the member state in whose territory the products (goods) are placed under customs procedures;
    • d) other documents provided for by the legislation of the member state in whose territory the products (goods) are placed under customs procedures.
  4. Documents certifying the conformity of products (goods) with mandatory requirements, or information about such documents are submitted to the customs authorities when placing products (goods) under customs procedures:
    • a) release for domestic consumption, including the customs procedure for release for domestic consumption, declared at the completion of other customs procedures, with the exception of products (goods) imported (imported):
      • as samples and samples for research and testing, provided that a copy of the contract with an accredited certification body (accredited testing laboratory (center)) is submitted to the customs authority or letters from such an accredited certification body (accredited testing laboratory (center)) confirming the quantity (weight and volume) of imported products (goods) required for these purposes;
      • by the manufacturer or an authorized representative of the manufacturer as spare parts for maintenance and repair of finished products previously imported into the customs territory of the Customs Union, in respect of which compliance with mandatory requirements has been confirmed, subject to submission tocustoms authoritiescopies of documents on the assessment (confirmation) of the conformity of such finished products;
      • as components of goods or raw materials (materials) for products put into circulation on the territory of the member state where they are placed under the customs procedure of release for domestic consumption;
      • to the address of diplomatic missions, consular offices, other official representations of foreign states, interstate and intergovernmental organizations, subject to the submission to the customs authority of their reasoned application for consumption (use) exclusively by such representations, institutions, organizations;
      • as humanitarian or technical assistance;
      • as goods intended for the prevention and elimination of natural disasters and other emergency situations;
    • b) temporary importation (admission), except in cases of temporary importation:
      • containers, packaging, pallets;
      • products (goods) intended for demonstration at exhibitions, fairs and international meetings, as well as auxiliary equipment and materials intended for use in such demonstration of products (goods) or for use at exhibitions, fairs and international meetings;
      • commodity samples intended solely for the purpose of receiving orders for products (goods) of this type and unsuitable for use for other purposes, which is ensured by applying indelible markings, breaks, punching holes or causing damage in any other way;
      • products (goods) intended for conducting tests, inspections, experiments and showing properties and characteristics;
      • advertising printed products;
      • equipment necessary for artists, theater troupes and orchestras (items used during performances, musical instruments, scenery and costumes), if such products (goods) are imported (imported) by a foreign person and will be used by him in the customs territory of the Customs Union;
      • professional cinematographic equipment, press equipment, radio or television, auxiliary devices and accessories to this equipment, if such professional equipment, devices and accessories are imported (imported) by a foreign person and will be used by him in the customs territory of the Customs Union;
      • products (goods) intended for sports competitions, demonstration sports events or training, if such products (goods) are imported (imported) by a foreign person and will be used by him in the customs territory of the Customs Union;
    • c) a free customs zone, with the exception of products (goods) imported (imported):
      • as spare parts for maintenance and repair of finished products previously imported into the customs territory of the Customs Union, placed under the customs procedure of release for domestic consumption or the customs procedure of a free customs zone, in respect of which compliance with mandatory requirements has been confirmed, provided copies of documents on the assessment (confirmation) of compliance of such finished products are submitted to the customs authorities;
      • as samples and samples for research and testing, subject to submission to the customs authority of a copy of the contract with an accredited certification body (accredited testing laboratory (center)) located on the territory of the member state where thecustoms declarationgoods, or letters from such an accredited certification body (accredited testing laboratory (center)) confirming the quantity (weight and volume) of imported goods required for these purposes;
      • as components of goods or raw materials (materials) for products manufactured on the territory of the member state where they are placed under the customs procedure of the free customs zone;
    • d) a free warehouse, with the exception of products (goods) imported (imported):
      • as spare parts for maintenance and repair of finished products previously imported into the customs territory of the Customs Union, placed under the customs procedure of release for domestic consumption or the customs procedure of a free warehouse, in respect of which compliance with mandatory requirements has been confirmed, subject to the submission to the customs authorities of copies of documents on the assessment (confirmation) of compliance of such finished products;
      • as samples and samples for research and testing, subject to submission to the customs authority of a copy of the contract with an accredited certification body (accredited testing laboratory (center)) located on the territory of the member state where thecustoms declaration of goods, or letters from such an accredited certification body (accredited testing laboratory (center)) confirming the quantity (weight and volume) of imported (imported) products (goods) required for these purposes;
      • as components of goods or raw materials (materials) for products manufactured in the territory of the member state where they are placed under the customs procedure of a free warehouse;
    • e) reimport, except for cases of placement under this customs procedure:
      • products (goods) in order to complete the customs procedure of temporary export;
      • products (goods) that have not undergone processing operations outside the customs territory of the Customs Union, in order to complete the customs procedure for processing outside the customs territory;
      • goods of the Customs Union placed under the customs procedure of the free customs zone or free warehouse, in order to complete the customs procedure of the free customs zone or the customs procedure of the free warehouse, if such goods of the Customs Union remained unchanged, except for changes due to natural wear or natural loss under normal conditions of transportation (transportation), storage and (or) use (operation);
    • f) refusal in favor of the state.
  5. Submission to the customs authorities of documents certifying the conformity of products (goods) with mandatory requirements, or information about such documents is not required:
    • a) when placing products (goods) under the customs procedures specified in paragraph 4 of this Regulation:
    • used (operational);
    • imported (imported) in single copies (quantities) provided for by one foreign trade agreement exclusively for the declarant's own use (including for research or representative purposes as souvenirs or promotional materials);
    • in cases of its temporary placement in the customs territory of the Customs Union, with the exception of imported (imported) under financial leasing agreements;
    • b) in relation to products (goods):
      • imported (imported) by individuals for personal use;
      • placed in temporary storage;
      • placed under customs procedures of customs transit, processing in the customs territory, processing for domestic consumption, customs warehouse, duty-free trade, destruction, special customs procedure;
      • imported (imported) as supplies.
