Decision of the EAEC Board No. 30 dated 21.04.2015 on non-tariff regulation measures

In accordance with article 46 of the Treaty onThe EAEUdated 29.05.2014 and paragraphs 4 and 37 of the Protocol on Non-Tariff Regulation Measures against Third Countries (Annex No. 7 to the EAEU Treaty dated 29.05.2014), the EAEU Board decided:

1. To introduce the following unified measures of non-tariff regulation in the customs territory of the EAEU:
   • prohibition of importation into the customs territory of the EAEU and (or) export from the customs territory of the EAEU of goods according to the list according to Appendix No. 1;
   • permissive procedure for importation into the customs territory of the EAEU and (or) export from the customs territory of the EAEU of goods according to the list according to Appendix No. 2.
2. To establish that the goods for which the unified non-tariff regulation measures specified in paragraph 1 of this Decision have been introduced are included in the unified list of goods to which non-tariff regulation measures are applied in trade with third countries, provided for in paragraph 4 of the Protocol on Non-Tariff Regulation Measures against Third Countries (Annex No. 7 to the EAEU Treaty from 29.05.2014) and published on the official website of the EAEU in the information and telecommunications network “Internet”.
3. The permissive procedure specified in paragraph 1 of this Decision is implemented through licensing and (or) the application of other administrative measures regulating foreign trade activities established in accordance with:
   • Regulations on the import into the Customs territory of the EAEU and export from the customs territory of the EAEU of human organs and tissues, blood and its components, samples of human biological materials according to Appendix No. 3;
   • Regulations on the export of mineral raw materials from the customs territory of the EAEU in accordance with Annex No. 4;
   • Regulations on the export of wild live animals, individual wild plants and wild medicinal raw materials from the customs territory of the EAEU in accordance with Annex No. 5;
   • Regulations on the export from the customs territory of the EAEU of rare and endangered species of wild living animals and wild plants included in the Red Books of the EAEU Member States, according to Annex No. 6;
   • Regulations on the import into the customs territory of the EAEU and export from the customs territory of the EAEU of hazardous waste in accordance with Annex No. 7;
   • Regulations on the export of cultural values, documents of national archival funds and originals of archival documents from the customs territory of the EAEU in accordance with Annex No. 8;
   • Regulations on the import into the customs territory of the EAEU and export from the customs territory of the EAEU of encryption (cryptographic) means according to Appendix No. 9;
   • Regulations on the import into the Customs territory of the EAEU and export from the customs territory of the EAEU of narcotic drugs, psychotropic substances and their Precursors in accordance with Annex No. 10.
   • Regulations on the import of plant protection products (pesticides) into the customs territory of the EAEU in accordance with Annex No. 11;
   • Regulations on the export from the customs territory of the EAEU of collection materials on mineralogy, paleontology, bones of fossil animals according to Appendix No. 12;
   • Regulations on the import into the customs territory of the EAEU and export from the customs territory of the EAEU of precious stones according to Annex No. 13;
   • Regulations on the import into the Customs territory of the EAEU and export from the customs territory of the EAEU of precious metals and raw materials containing precious metals, according to Annex No. 14;
   • Regulations on the import into the customs territory of the EAEU of radio-electronic means and high-frequency devices for civil purposes, including embedded or included in other goods, according to Annex No. 15;
   • Regulations on the import into the customs territory of the EAEU and export from the customs territory of the EAEU of special technical means intended for the secret receipt of information, according to Annex No. 16;
   • Regulations on the import into the customs territory of the EAEU and export from the customs territory of the EAEU of civil and service weapons, their main (component) parts and cartridges for it according to Annex No. 17;
   • The Regulation on the export from the customs territory of the EAEU of information on subsurface resources by areas and deposits of fuel, energy and mineral raw materials in accordance with Annex No. 18.
   • The Regulation on the import into the customs territory of the EAEU of toxic substances that are not precursors of narcotic drugs and psychotropic substances, according to Annex No. 19. - the paragraph has been included since 03.07.2016 according to the Decision of the Board of the Eurasian Economic Commission No. 57 of 02.06.2016
   • Regulations on the import into the Customs territory of the EAEU and export from the customs territory of the EAEU of ozone-depleting substances and products containing ozone-depleting substances, according to Annex No. 20; - the paragraph has been included since 30.09.2016 according to the Decision of the Board of the EAEU No. 99 of 30.08.2016
   • Regulations on the import of medicines into the customs territory of the EAEU in accordance with Annex No. 21; - the paragraph has been included since 30.09.2016 according to the Decision of the Board of the EAEU No. 99 of 30.08.2016
   • The Regulation on the import into the Customs territory of the EAEU of plant protection products and Other Persistent Organic pollutants to be used in laboratory-scale studies, as well as as a reference standard, according to Annex No. 22. - the paragraph has been included since 18.07.2018 according to the Decision of the Board of the EAEU No. 100 of 13.06.2018
4. Licenses forexportand (or) import, conclusions (permits) for the import and (or) export of goods, other documents issued before the entry into force of this Decision by the relevant authorities of the EAEU member states in order to implement non-tariff regulation measures, as well as notifications, information about which is included in the unified register of notifications on the characteristics of encryption (cryptographic) funds and goods containing them, before the entry into force of this Decision, are valid until the expiration of their validity.
5. To invalidate the decisions of the Customs Union Commission and the EAEC Board on the list according to Annex No. 23. - paragraph in the wording of the Decision of the EAEC Board No. 131 dated 06.10.2015, the Decision of the EAEC Board No. 57 dated 02.06.2016, the Decision of the EAEC Board No. 99 dated 30.08.2016 and the Decision of the EAEC Board No. 100 dated 13.06.2018
6. This Decision comes into force after 30 calendar days from the date of its official publication.
