Resolution of the Government of the Russian Federation No. 1255 dated September 13, 2024 "On Amendments to Certain Acts of the Government of the Russian Federation"/h3>

The Government of the Russian Federation DECIDES:/p>

  1. To approve the attached amendments to the acts of the Government of the Russian Federation./li>
  2. To establish that for calculating the amount of the recycling fee in respect of vehicles imported into the Russian Federation, the list of types and categories of wheeled vehicles (chassis) and trailers to them, in respect of which the recycling fee is paid, as well as the amount of the recycling fee, approved by Decree of the Government of the Russian Federation dated December 26, 2013 N 1291 "On Recycling Fees in respect of wheeled vehicles (chassis) and trailers to them and on Amendments to Certain Acts of the Government of the Russian Federation" (as amended by Decree of the Government of the Russian Federation No. 76 dated January 31, 2024 "On Amendments to Certain Acts of the Government of the Russian Federation"), subject to submission to the customs authority of the said calculation of the amount of the recycling fee no later than October 15, 2024/li>
  3. Subparagraph "b" of paragraph 2 of the amendments to the acts of the Government of the Russian Federation approved by Decree of the Government of the Russian Federation No. 1547 of September 22, 2023 "On Amendments to Certain Acts of the Government of the Russian Federation" (Collection of Legislation of the Russian Federation, 2023, No. 39, art. 7052), shall be declared invalid./li>
  4. This resolution comes into force on October 1, 2024./li>

p style="text-align: center;">AMENDMENTS TO ACTS OF THE GOVERNMENT OF THE RUSSIAN FEDERATION/p>
  1. In the decree of the Government of the Russian Federation of December 26, 2013 N 1291 "On recycling fees for wheeled vehicles (chassis) and trailers to them and on Amendments to Certain Acts of the Government of the Russian Federation" (Collection of Legislation of the Russian Federation, 2014, No. 2, Article 115; 2016, No. 7, Article 991; 2017, No. 42, Article 6156; 2019, No. 15, art. 1756; N 48, art. 6829; 2020, N 47, art. 7560; 2022, N 48, art. 8501; 2023, N 28, art. 5232; N 39, art. 7052; N 43, art. 7723; 2024, N 1, art. 267; N 6, art. 841):ul>
  2. a) in the Rules for the collection, Calculation, payment and Collection of a Recycling fee in respect of wheeled vehicles (chassis) and Trailers to them, as well as the refund and offset of overpaid or overpaid amounts of this fee, approved by the said resolution:ul>
  3. in the second paragraph of paragraph 8:ul>
  4. the words "or on the basis of non-payment of the disposal fee" should be deleted;/li>
  5. add the following sentence: "Information on the grounds for non-payment of the recycling fee is entered into the electronic passport of the vehicle (electronic passport of the vehicle chassis) in accordance with the specified Procedure based on information from the Federal Customs Service.";/li>
  6. in paragraph 11:/span>
    • Subparagraph "e" should be worded as follows:ul>
    • ""f) copies of transport (transportation) documents (if available);";/li>
  7. subparagraph "k" after the words "eco-class tractor units" should be supplemented with the words "Euro-5 and";/span>
  8. add the following subparagraph "m":/span>
    • ""m) documents confirming that the vehicle is being imported into the Russian Federation by a family member of a participant in the State Program to Facilitate the Voluntary Resettlement to the Russian Federation of Compatriots Living Abroad (if there are appropriate grounds).";/li>
  9. Add paragraph 11 (7) to read as follows:/span>
    • ""11(7). The payer or his authorized representative, along with the documents specified in paragraph 11 of these Rules, shall submit documents confirming the existence of grounds for exemption from payment of customs duties and taxes in accordance with paragraph 6 of Appendix No. 3 to Decision No. 107 of the Council of the Eurasian Economic Commission dated December 20, 2017. "On certain issues related to goods for personal use" (in the case of importation of a wheeled vehicle into the Russian Federation by an individual recognized as having moved to a permanent place of residence in the Russian Federation, with exemption from customs duties and taxes in accordance with paragraph 6 of Appendix No. 3 to the decision of the Council of the Eurasian Economic Commission dated December 20, 2017 G. N 107 "About certain issues related to goods for personal use").";/li>
  10. the first paragraph of paragraph 12 after the word "documents" should be supplemented with the words "within a period not exceeding 5 working days from the date of submission of the calculation of the disposal fee,";/span>
  11. Paragraph 13 should be worded as follows:/span>
    • ""13. The customs authority issues a customs receipt order to the payer or his authorized representative. The procedure for filling out and using a customs receipt order and additional sheets in connection with the payment of a disposal fee is determined in accordance with Article 29 of the Federal Law "On Customs Regulation in the Russian Federation and on Amendments to Certain Legislative Acts of the Russian Federation."";/li>
  12. b) the list of types and categories of wheeled vehicles (chassis) and trailers to them, in respect of which a recycling fee is paid, as well as the amount of the recycling fee, approved by the said resolution, should be set out in the following wording:/span>

Notes to the tables/h3>

  1. The identification code is specified for the purposes of collection by the Federal Tax Service of the recycling fee for self-propelled vehicles and trailers to them./li>
  2. The rated power of the power plant is taken into account. If in the field "Engine power (engines), kW (hp)" of the unified form of the passport of a self-propelled machine and other types of equipment this value is indicated only in kilowatts, the ratio is used to calculate and pay the utilization fee when converted into horsepowerstrong>11 kW = 1.35962 hp/strong>
  3. The amount of the recycling fee per category (type) of self-propelled vehicle and trailer is equal to the product of the base rate and the coefficient provided for a specific item. The base rate for calculating the amount of the recycling fee for self-propelled vehicles and trailers is 172,500 rubles, and for trucks and trailers it is 150,000 rubles. The date of manufacture of self-propelled vehicles and trailers to them is determined in accordance with the Procedure for determining the moment of release and engine capacity of an automobile or motor vehicle, established by Annex 6 to the Agreement on the Procedure for the Movement of Goods for Personal Use by Individuals across the Customs border of the Customs Union and performing customs operations related to their Release, dated 06/18/2010. The date of manufacture of self-propelled vehicles and (or) trailers to them for the purpose of collecting a recycling fee by the Federal Tax Service is indicated in the passport of a self-propelled vehicle and other types of equipment./li>
  5. The classification code is given in accordance withspan class="mytool">HS/a> The EAEU. If the same EAEU HS code and different coefficients for calculating the amount of the recycling fee are provided for different types of self-propelled vehicles, and at the same time the name of the self-propelled vehicle does not correspond to any of the sections of this list, the calculation of the amount of the recycling fee is carried out by a higher coefficient. If the document on the assessment of compliance of a self-propelled vehicle or trailer with the requirements of the technical regulations of the Customs Union "On the safety of machinery and equipment" (span class="mytool">TR CU/a> 010/2011) or the technical regulations of the Customs Union "On the safety of agricultural and forestry tractors and trailers to them" (TR CU 031/2012) indicates the HS code of the EAEU, different from the code according to which, in accordance with Article 20 of the Customs Code of the EAEU, the specifiedspan class="mytool">product/a> classified by the customs authorities, for the purpose of calculating and paying the recycling fee, the EAEU HS code is used, according to which the goods are classified by the customs authorities. If the EAEU HS code is specified in the documents confirming compliance in accordance with the previously valid version, the recycling fee is paid on the basis of the tables of conformity of the EAEU HS codes at the level of commodity items, sub-items and sub-items./li>
  6. The gross vehicle weight is the road weight specified by the manufacturer as the maximum design weight of the vehicle. It is equal to the sum of the vehicle's own weight and the maximum weight of the cargo, the driver and the full fuel tank./li>
  7. The technically permissible maximum mass is understood to be the maximum mass of a vehicle with equipment, passengers and cargo set by the manufacturer, due to its design and specified characteristics./li>
  8. The control weight is the empty weight minus the driver's weight of 75 kg and plus the weight of 100 kg./li>
  9. & The load capacity of a trailer is understood to be the maximum weight of the cargo for which the trailer is designed to be transported, set by the manufacturer (manufacturer)./li>
  10. Equipment and installations located on special vehicles (cranes,span class="mytool">vehicles/a>, equipped with lifts with working platforms, tow trucks, etc.), are equated to cargo./li>

      If the distance between the centers of the contact spots with the road surface of the wheels of one axle is less than 460 mm, such vehicles belong to the L3 category./span>

The height of the center the weight of such tractors (with conventional tires) is less than 850 mm. Category/li>
  • TT5/strong>:: wheeled tractors with a maximum design speed of more than 40 km/h./li>
  • Categorystrong>CC/strong> - tracked tractors.ul>

  • Categorystrong>RR3/strong> - trailers, the technically permissible total weight of which is more than 3,500 kg, but does not exceed 21,000 kg./li>
  • Categorystrong>RR4 -/strong>& trailers with a technically permissible total weight exceeding 21,000 kg.Each category of trailers, depending on the maximum design speed, has the letter a or b in the designation:/li>
  • aa – trailers with a maximum design speed of no more than 40 km/h;/li>

    • Categorystrong>GG/strong> - All-terrain vehicles This group may include vehicles of categories M and N if they meet the following requirements:ul>
    • Vehicles of category N1, technically permissible maximum mass of which is not more than 2 tons, as well as vehicles of category M1 are considered cross-country vehicles if they have:/span>
      • At least one front and one rear axles, the design of which ensures their simultaneous drive, including vehicles in which the drive of one axis can be switched off;/li>
      • At least one differential locking mechanism or one mechanism of similar action and if they (in the case of a single vehicle) can overcome a 30% rise./li>
      • They must also meet at least five of the six requirements listed below:/span>
        1. The angle of entry must be at least 25°;/li>
        2. The exit angle must be at least 20°;/li>
        3. The longitudinal cross-country angle must be at least 20°;/li>
        4. The ground clearance under the front axle must be at least 180 mm;/li>
        5. The ground clearance under the rear axle must be at least 180 mm;/li>
        6. The centerline ground clearance must be at least 200 mm./li>
    • Vehicles of category N1 with a technically permissible maximum mass exceeding 2 tons, or vehicles of categories N2, M2 or M3 with a technically permissible maximum mass of no more than 12 tons, are considered all-terrain vehicles if their design provides simultaneous drive of all wheels, including vehicles in which the drive of one axle can be switched off, or if they meet the following requirements:/span>
      • At least one front and one rear axles have simultaneous drive, including vehicles in which the drive of one axle can be switched off;/li>
      • There is at least one differential locking mechanism or one mechanism of similar action;/li>
      • Vehicles (in the case of a single vehicle) can overcome a rise of 25%./li>
    • Vehicles of category M3 with a technically permissible maximum mass exceeding 12 tons, and vehicles of category N3 (with the exception of tractor units) they are considered all-terrain vehicles if they have simultaneous drive of all wheels, including vehicles in which the drive of one axle can be switched off, or if the following requirements are met:/span>
      1. The angle of entry must be at least 25°;/li>
      2. The exit angle must be at least 25°;/li>
      3. The longitudinal cross-country angle must be at least 25°;/li>
      4. The ground clearance under the front axle must be at least 250 mm;/li>
      5. The centerline ground clearance must be at least 300 mm;/li>
      6. The ground clearance under the rear axle must be at least 250 mm./li>
      • At least half of the axles are driven;/li>
      • There is at least one differential locking mechanism or one mechanism of similar action;/li>
      • Vehicles (in the case of a single vehicle) can climb 25%;/li>
      • At least four of the following six requirements are met:/li>

    Special and specialized vehicles manufactured on the basis (chassis) of vehicles of category G belong to category G if they meet the requirements above./span>

    When marking the category of all-terrain vehicles, the letter G must be combined with the letters M or N (for example, N1G)./span>

    Notes:/p>

    1. When conducting an inspection in order to classify vehicles into category G, vehicles of category N1 with a technically permissible maximum mass of no more than 2 tons and vehicles of category M1 must be in running order, i.e. filled with coolant, lubricant, fuel, equipped with tools and a spare wheel, the standard weight of the driver must also be taken into account, taken equal to 75 kg . The remaining vehicles must be loaded to the technically permissible maximum mass set by the manufacturer./li>
    2. The ability of the vehicle to overcome the rise of the set value (25% or 30%) is confirmed by the calculation method; however, technical services may require the presentation of a vehicle of the appropriate type for a real test./li>
    3. When measuring the angle of entry and exit angle, as well as the longitudinal angle of cross-country, protective devices are not taken into account./li>
    4. The following definitions apply regarding the angle of entry and the angle of exit, as well as the longitudinal angle of cross-country and ground clearance:ul>
    5. the entrance angle is according to ISO 612 standard;/li>
    6. exit angle - according to ISO 612 standard;/li>
    7. the longitudinal cross-country angle is according to ISO 612 standard;/li>
    8. The centerline ground clearance is the shortest distance between the reference plane and the lowest point of the vehicle located on its rigid element. Multi-axle trolleys are considered as one axis;/li>
    9. ground clearance under one axis is the distance between the upper point of the arc of a circle passing through the centers of the tire contact spots of one axis (in the case of twin tires, the tires of the inner wheels of the axis) and touching the lowest point of the vehicle, rigidly fixed between the wheels, and the reference plane./li>
