The EAEU Technical Regulation “On the Restriction of the Use of Hazardous Substances in Electrical and Radio Electronics Products” (EAEU TR 037/2016)

I. Scope of application

  1. Realtechnical regulationsdeveloped in accordance with the Treaty on the Eurasian Economic Union of 29.05. 2014 in order to ensure the protection of human life and health, the environment, as well as the prevention of actions misleading consumers (users) of electrical and radio electronics products regarding the content of hazardous substances in them.
    This technical regulation establishes mandatory requirements for application and enforcement on the territory of the Eurasian Economic Union (hereinafter referred to as the Union) to limit the use of hazardous substances in electrical engineering and radioelectronics products released into circulation on the territory of the Union to ensure their free movement.
    If other technical regulations of the Union (Customs Union) have been adopted with respect to electrical engineering and radio electronics products that establish requirements for these products, then such electrical engineering and radio electronics products must comply with the requirements of all technical regulations of the Union (Customs Union), which apply to them.
  2. The effect of this technical regulation applies to electrical and radio electronics products put into circulation on the territory of the Union according to the list according to Appendix No. 1.
  3. This technical regulation does not apply to:
    • a) electrical and radio electronics products intended for use at a rated voltage of more than 1000 V AC and 1500 V DC, unless otherwise provided by Appendix No. 1 to this technical regulation;
    • b) electrical and radio electronics products intended exclusively for use as components of electrical equipment not included in the list provided for in Annex No. 1 to this technical regulation;
    • c) electric toys;
    • d) photovoltaic panels (solar panels) included in the products of electrical engineering and radio electronics;
    • e) electrical and radio electronics products intended for use as part of ground-based and orbital space objects;
    • f) electrical equipment intended exclusively for use on air, water, ground and underground transport;
    • g) electric batteries and accumulators, including those put into circulation on the territory of the Union as part of electrical engineering and radio electronics products;
    • h) used (operational) electrical and radio electronics products;
    • i) measuring instruments;
    • k) medical devices.

II. Basic concepts

  1. For the purposes of the application of this technical regulation, concepts are used that mean the following:
    • “toy" - a product or material intended for the play of a child (children) under the age of 14;
    • “electric toy” is a toy in which at least one function is performed at the expense of electrical energy;
    • “products of electrical engineering and radio electronics” - products whose functioning for its intended purpose is due to the presence, application, generation, conversion, transmission and distribution of electric currents and (or) electromagnetic fields that are intended for direct use or are built into machines, mechanisms, apparatuses, devices and other equipment;
    • “importer” is a resident of a member State of the Union who has concluded a foreign trade agreement with a non-resident of a member State of the Union for the transfer of electrical and radio electronics products, implements these products and is responsible for their compliance with the requirements of this technical regulation;
    • “homogeneous (homogeneous) material” means a material with a constant composition in its entire volume, consisting of one substance or a combination of substances and (or) materials that cannot be separated mechanically (by disassembly, cutting, grinding, grinding or other mechanical action).

III. Rules for the circulation of electrical and radio electronics products on the Union market

  1. A product of electrical engineering and radio electronics is put into circulation on the territory of the Union if it complies with this technical regulation, as well as other technical regulations of the Union (Customs Union), which apply to it, and provided that it has passed conformity assessment in accordance with Section VII of this technical regulation, as well as in accordance with other technical regulations of the Union (Customs Union), the effect of which extends to it.
  2. An electrical and radio electronics product whose compliance with the requirements of this technical regulation, as well as the requirements of other technical regulations of the Union (Customs Union) is not confirmed, should not be marked with a single product circulation mark on the Union market.

IV. Requirements for limiting the use of hazardous substances

  1. The product of electrical engineering and radio electronics must be designed and manufactured in such a way that it does not contain:
    • a) hazardous substances according to the list according to Annex No. 2;
    • b) homogeneous (homogeneous) materials containing hazardous substances in concentrations exceeding the permissible level specified in the list provided for in Annex No. 2 to this technical regulation.
  2. With regard to electrical and radio electronics products, special requirements have been established to limit the use of hazardous substances in accordance with Annex No. 3.

V. Requirements for marking and operational documents

  1. The name and (or) designation of the electrical and radio electronics product (type, brand, model (if available)), its main parameters and characteristics, the name and (or) trademark of the manufacturer, the name of the state in which the electrical and radio electronics product is manufactured, must be applied to this product and indicated in the attached operational documents.
    In this case, the name and (or) designation of the electrical and radio electronics product (type, brand, model (if available)), the name and (or) trademark of the manufacturer must also be applied to the packaging.
  2. If the information provided for in paragraph 9 of this technical regulation cannot be applied to an electrical and radio electronics product, then they can only be indicated in the operational documents attached to this product. In this case, the name and (or) designation of the electrical and radio electronics product (type, brand, model (if available)), the name and (or) trademark of the manufacturer must be applied to the packaging.
  3. Markingelectrical and radio electronics products must be legible, easy to read and must be applied to the electrical and radio electronics product in a place accessible for inspection without disassembly using a tool.
  4. The operational documents for the product of electrical engineering and radio electronics must contain:
    • a) the information specified in paragraph 9 of this technical regulation;
    • b) information about the purpose of the product;
    • c) product characteristics and parameters;
    • d) rules and conditions of operation (use), installation, storage, transportation (transportation), sale and disposal of the product (if necessary - relevant requirements);
    • e) information about the measures to be taken when a malfunction of the product is detected;
    • f) the name and location of the manufacturer (the person authorized by the manufacturer), the importer, their contact details;
    • g) information about the month and year of manufacture of the product and (or) about the place of application of such information or the method of determining the year of manufacture.
  5. Marking and drawing up of operational documents are carried out in Russian and, if there are relevant requirements in the legislation of the Member States of the Union (hereinafter referred to as the Member States) - in the state language (official languages) of the Member State on whose territory the products are sold. Units of measurement, letter trademarks, proper names, names of settlements and other names and details in the marking and operational documents may be given in other languages.
    Operational documents are issued on paper. They may be accompanied by a set of operational documents on an electronic medium. Operational documents included in the set of electrical and radio electronics products for non-household purposes can only be issued on electronic media.

VI. Ensuring compliance of electrical and radio electronics products with the requirements of technical regulations

  1. Compliance of electrical and radio electronics products with this technical regulation is ensured by the fulfillment of its requirements for limiting the use of hazardous substances.
  2. Methods of research (testing) and measurements of electrical and radio electronics products are established by standards included in the list of standards containing rules and methods of research (testing) and measurements, including sampling rules necessary for the application and fulfillment of the requirements of this technical regulation and the assessment of conformity of products.

VII. Conformity assessment of electrical and radio electronics products

  1. Conformity assessmentelectrical and radio electronics products are produced in the form of conformity assessment.
  2. When confirming the conformity of electrical and radio electronics products, applicants may be a legal entity or an individual registered in the territory of a Member State in accordance with its legislation as an individual entrepreneur, who are manufacturers or importers (sellers) or persons authorized by the manufacturer.
  3. Electrical and radio electronics products are subject to conformity assessment in the form of declaration of conformity according to one of the following schemes:
    • a) for mass-produced products - schemes 1d, 3d and 6d;
    • b) for a batch of products - 2d and 4d schemes.
  4. When declaring the conformity of electrical and electronic products, the applicant may be:
    • a) for schemes 1d, 3d and 6d - the manufacturer (a person authorized by the manufacturer);
    • b) for 2d and 4d schemes - the manufacturer (a person authorized by the manufacturer) or the importer (seller).
  5. The choice of the scheme of declaration of conformity of electrical and electronic products is carried out by the applicant.
  6. Declaration of conformity of electrical and radio electronics products according to schemes 1d and 2d is carried out by the applicant on the basis of his own evidence. Tests of samples of electrical engineering and radio electronics products at the applicant's choice are carried out in the applicant's testing laboratory, or in an accredited testing laboratory (center) included in the Unified Register of Certification Bodies and Testing Laboratories (Centers) of the Customs Union (hereinafter - the Unified Register), or in another testing laboratory.
    Declaration of conformity of electrical and radio electronics products according to 3d, 4d and 6d schemes is carried out by the applicant on the basis of his own evidence and evidence obtained with the participation of an accredited testing laboratory (center) included in the Unified Register.
  7. When declaring the conformity of electrical and radio electronics products, the applicant:
    • a) forms and analyzes documents confirming compliance of products with the requirements of this technical regulation, including:
      • technical specifications (if available);
      • operational documents;
      • the protocol (protocols) of tests of samples of products and (or) components, materials, components of products for compliance with the requirements of this technical regulation and (or) other documents at the applicant's choice, which served as the basis for confirming compliance of products with the requirements of this technical regulation (if available) (schemes 1d, 2d, 3d, 4d and 6d);
      • supply contract (the contract) and shipping documentation (if available) (for a batch of products, a single product) (schemes 2d and 4d);
      • certificate for the quality management system (a copy of the certificate) (scheme 6d);
    • b) carries out the identification of products in order to assign them to the scope of this technical regulation;
    • c) ensures that production control is carried out and takes all necessary measures to ensure that the production process of products ensures their compliance with the requirements of this technical regulation;
    • d) takes all necessary measures to ensure the stability of the functioning of the quality management system (scheme 6d);
    • e) adopts a declaration of conformity, which is drawn up in accordance with the uniform form and rules approved by the Decision of the EAEC Board of December 25, 2012 No. 293;
    • f) applies a single product circulation mark on the Union market after completion of the conformity assessment procedure;
    • g) forms, after completion of the conformity assessment procedure, a set of documents, which includes the documents provided for in subparagraph “a" of this paragraph, and a declaration of conformity.
  8. Declaration of Conformitysubject to registration in accordance with the procedure provided for by the Decision of the EAEC Board dated 09.04.2013 No. 76.
  9. The validity period of the declaration of conformity for mass-produced electrical and radio electronics products is no more than 5 years. For a batch of electrical and radio electronics products, the validity period of the declaration of conformity is not established.
  10. At the applicant's choice, confirmation of conformity of electrical and radio electronics products in the form of declaration of conformity can be replaced by confirmation of conformity in the form of certification according to one of the following schemes:
    • a) for mass-produced products - schemes 1c, 2c and 6s;
    • b) for a batch of products - scheme 3c.
  11. When certifying electrical and radio electronics products, the applicant may be:
    • a) for schemes 1c, 2c and 6s - the manufacturer (a person authorized by the manufacturer);
    • b) for scheme 3c - the manufacturer (a person authorized by the manufacturer) or the importer (seller).
  12. The selection of the certification scheme for electrical and electronic products is carried out by the applicant.
  13. When certifying electrical and radio electronics products, the applicant:
    • a) takes all necessary measures to ensure that the production process of products is stable and ensures their compliance with the requirements of this technical regulation;
    • b) forms the following technical documentation:
      • technical specifications (if available);
      • operational documents;
      • supply agreement (contract) and shipping documentation (if available) (for a batch of products) (scheme 3c);
      • certificate for a quality management system (a copy of the certificate) (scheme 2c);
      • other documents at the applicant's choice, which served as the basis for confirming the conformity of products with the requirements of this technical regulation (if any);
    • c) submits an application for certification of products to the certification body included in the Unified Register (with the attachment of technical documentation). The application contains information about the document for compliance with the requirements of which the quality management system is certified (scheme 2c), as well as identifying features of the batch of products and its constituent units (scheme 3c);
    • d) applies a single product circulation mark on the Union market after completion of the conformity assessment procedure;
    • e) in case of changes in the design of products or their production technology that may affect the compliance of such products with the requirements of this technical regulation, notify the certification body in advance (scheme 1c);
    • f) forms, after completion of the conformity assessment procedure, a set of documents that includes the documents provided for in subparagraph “b” of this paragraph, the test report (protocols), the results of the analysis of the state of production (scheme 1c) andcertificate of conformity.
  14. When certifying electrical and radio electronics products, the certification body included in the Unified Register:
    • a) analyzes the technical documentation submitted by the applicant and informs the applicant of its decision (indicating the conditions for certification);
    • b) carries out the identification of product samples and their selection from the applicant for testing;
    • c) provides testing of product samples (batch of products (samples from the batch) (scheme 3c)) in an accredited testing laboratory (center) included in the Unified Register;
    • d) conductsanalysisthe state of the applicant's production, the results of which are formalized by an act (scheme 1c);
    • e) in case of positive test results and analysis of the state of production, issue a certificate of conformity in a single form approved by the Decision of the EAEC Board No. 293 dated December 25, 2012, and issue it to the applicant;
    • f) enter information about the certificate of conformity into the unified register of issued certificates of conformity and registered declarations of conformity;
    • g) conducts inspection control over certified products during the entire validity period of the certificate of conformity by testing product samples in an accredited testing laboratory (center) included in the Unified Register and (or) analyzing the state of production (scheme 1c);
    • h) conducts inspection control over certified products during the entire validity period of the certificate of conformity by testing product samples in an accredited testing laboratory (center) included in the Unified Register and analyzing the results of inspection control of the quality management system certification body in relation to the certified quality management system (scheme 2c);
    • i) if the inspection control results are positive, confirms the validity of the certificate of conformity and makes an appropriate entry in the inspection control act, if the inspection control results are negative, decides to suspend or cancel the certificate of conformity and brings information about the decision to the applicant (schemes 1c and 2c).
  15. If conformity assessment (declaration of conformity or certification) is carried out according to schemes providing for certification of a quality management system, certification of such a system is carried out by a quality management system certification body registered in the territory of a Member State in accordance with the legislation of that state and accredited in the national accreditation system of the member State.
  16. The validity period of the certificate of conformity for mass-produced electrical and radio electronics products is no more than 5 years. For a batch of electrical and radio electronics products, the validity period of the certificate of conformity is not set.
  17. A set of documents formed after confirming the conformity of electrical and radio electronics products is stored:
    • a) for mass-produced products - the applicant has at least 10 years from the date of termination of the declaration of conformity or certificate of conformity;
    • b) for a batch of products - the applicant has at least 10 years from the date of the end of the sale of the batch of products;
    • c) for a product - the manufacturer (a person authorized by the manufacturer) has at least 10 years from the date of decommissioning (termination of production) of this product.

VIII. Marking with a single product circulation mark on the Union market

  1. An electrical and radio electronics product that meets the requirements of this technical regulation and has passed the conformity assessment procedure in accordance with section VII of this technical regulation must be marked with a single product circulation mark on the Union market.
  2. Marking with a single product circulation mark on the Union market is carried out before the release of electrical and radio electronics products into circulation on the Union market.
  3. A single product circulation mark on the Union market is applied to each product of electrical engineering and radio electronics in any way that provides a clear and clear image during the entire service life of the product, and is also given in the accompanying operational documents.
    If it is impossible to apply a single product circulation mark on the Union market to an electrical and radio electronics product, it is allowed to apply it only on the packaging of the product and in the operational documents attached to it.
  4. A product of electrical engineering and radio electronics is marked with a single product circulation mark on the Union market if it complies with the requirements of all technical regulations of the Union (Customs Union), which apply to it

    • y) extension cords.
  2. Electronic computers and devices connected to them, including their combinations:
    • a) servers, system blocks of personal computers;
    • b) laptops;
    • c) tablet, pocket, handheld and other small-sized computers;
    • d) keyboards, manipulators, trackers and other control and input devices (computer mice, joysticks, helmets, glasses);
    • e) removable storage devices;
    • f) monitors;
    • g) printers;
    • h) scanners;
    • i) speakers and headphones;
    • k) multimedia projectors;
    • l) biometric information readers;
    • m) webcams;
    • h) modems;
    • o) uninterruptible power supply units.
  3. Telecommunication facilities (terminal telecommunication devices):
    • a) landline and mobile phones;
    • b) pay phones;
    • c) telefaxes;
    • d) telexes;
    • e) portable and portable radios;
    • f) radio frequency identification tags.
  4. Copiers and other electrical office (office) equipment.
  5. Electrified tools (manual and portable electric machines).
  6. Light sources and lighting equipment, including equipment embedded in furniture.
  7. Electric musical instruments.
  8. Slot machines and vending machines.
  9. Cash registers, ticket printing machines, ID card readers, ATMs, information kiosks.
  10. Cables, wires and cords intended for use at a rated voltage of no more than 500 V AC and (or) DC, with the exception of fiber-optic cables.
  11. Automatic switches and protective disconnection devices.
  12. Fire, security and fire alarm detectors.
